2. Data processing by the website

2.1. Storage duration and deletion of data

The personal data collected, processed and stored by us is only stored as long as the specific purpose of the storage requires. If the purpose of storage is no longer necessary, your data will be deleted or its processing will be restricted. However, in addition to this, it may be that European regulations, the applicable national laws or other regulations may require longer storage of the data that we process. If these periods of storage expire, we will delete your data or limit its processing.

2.2 Server statistics

Each time you visit our GOVECS website, our system automatically collects data and information from your computer system. In particular, the following data will be collected:

  • Information about your browser type
  • Information about your operating system
  • Information about your internet service provider
  • Your IP address
  • Date and time of your visit to our site
  • Information about the website from which your system accessed our website
  • Information about the website that is accessed by your system through our website.

The mentioned data that we have collected about you is stored in the log files of our system. Storing this data together with other personal data does not happen.

The legal basis for the temporary storage of data and log files is article 6, paragraph 1, sentence 1, point f of GDPR. We have a legitimate interest in collecting and temporarily storing such information as temporary storage of the IP address by the system is necessary to allow delivery of the website to your computer.

Storage in log files is done to ensure the functionality of the website. In addition, this data is used to optimize our website and to ensure the security of our information technology systems. An evaluation of your log files for marketing purposes does not take place. One exception is the information we collect about your browser settings. This also includes checking the language setting in your browser in order to be able to display the corresponding language version of the GOVECS website.

The data is deleted or alienated, so that allocation to you is no longer possible, as soon as it is no longer necessary for the purpose mentioned here. If the data is stored in log files, the data is deleted after seven days.

3. Newsletter

3.1. Registration

On www.govecsgroup.com, you have the option to subscribe to a free newsletter. If you agree, we will inform you about the latest GOVECS e-scooters. We will also inform you at which event we are representing our products and where you can test drive it. We will also inform you about the possibility of participating in competitions, cash back campaigns and other sales promotions. In this process, the data you enter in the entry form when you sign up for the newsletter will be sent to us. Usually, this will contain:
•    Your e-mail-address
•    Your first and last name

We need your e-mail address to send you the newsletter and to identify and check your consent. Your first and last name are used to personalize the newsletter and are not mandatory for registration.
To register for our newsletter, we use the so-called double opt-in process. This means that once you have registered, we will send you an e-mail to the e-mail address that you have provided, in which we will ask you to confirm whether you wish to receive the newsletter. If you do not confirm your registration within 24 hours, your data will be automatically deleted after one month. After your confirmation, we will save your e-mail address as well as further details, for the purpose of sending the newsletter. The legal basis for this is Article 6, para. 1, sentence 1, point a of DSGVO.

We also store your IP addresses and time of registration and confirmation. The purpose of the procedure is to prove your registration and, if necessary, to clarify possible misuse of your personal data. The legal basis is Article 6, para. 1, sentence 1, point f of DSGVO.
We will delete your data as soon as you have unsubscribed from the newsletter or it will be cancelled by us. You may cancel the newsletter subscription at any time by revoking your consent with future effect. Each newsletter sent to you contains a link that allows you to unsubscribe easily. You can also send an email to datenschutz@govecs.com or send a message to the person-in-charge named above for this privacy policy.

3.2. Newsletter processing by HUBSPOT

We use the HubSpot service to provide the newsletter registration form (details on the provider under point 6.8). In this context, we forward the data you enter in the form to HubSpot, which processes the data exclusively on our behalf.
The service provider is used on the basis of our legitimate interests (Art. 6 para. 1 lit. f DSGVO), whereby our legitimate interest lies in the professional and efficient implementation of customer communication and marketing activities. The use of the service provider is secured by the conclusion of the standard contractual clauses of the European Commission.

4. Contact with GOVECS

4.1 E-Mail

On our GOVECS website, you will find several e-mail addresses which you can use depending on the nature of your request (for example sales or press) to contact us. Send us an e-mail and we will save your e-mail address as well as other data provided by you.
The legal basis for the processing is article 6, paragraph 1, sentence 1, point b and f of GDPR, since the establishment of contact can be an initiation of an agreement. GOVECS also has a legitimate interest in processing your data in order to respond to you. The data will be deleted as soon as it is no longer necessary for the purpose of collection and the deletion also does not conflict with any legal or contractual archiving obligations. The conversation ends when it can be inferred from the circumstances that the facts are finally clarified.
At the time of sending your message, the following data is also stored:

  • Your IP address
  • Date and time of your contact

This other personal data processed during the submission process is intended to prevent misuse of the e-mail and to ensure the security of our information technology systems. The additional personal data collected during the sending process will be deleted at the latest after a period of seven days. The data is used exclusively for processing the conversation. The legal basis for the processing of the data is article 6, paragraph 1 sentence 1 point b or f of GDPR.

 

4.2. Transfer to our partners

The data sent to us by you may be forwarded to our partners, as long as the content of your request thematically and regionally refers to them. However, GOVECS remains your first point of contact in this case and you can continue to assert your rights against GOVECS.
The legal basis for forwarding to our partners is article 6 paragraph 1 sentence 1 points b and f of GDPR. As long as your request relates to our partners or they can provide meaningful assistance with your enquiry, GOVECS has a justified interest in turning them in to handle optimally your request. We will delete your data if it is no longer necessary and there are no legal contractual obligations

 

4.3. hubspot

6. Included third party services

6.1. Google analytics

Our GOVECS website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Analytics also uses cookies. The information generated by the cookies about your use of our GOVECS website may also be transferred to and stored on a server of Google's parent company in the USA, Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. On the GOVECS website, IP anonymisation is carried out so that your IP address is shortened beforehand by Google within the member states of the European Union or in other states party to the Agreement on the European Economic Area ("EEA"). Only in exceptional cases will the full IP address be transferred to a Google server in the USA and only then shortened. On behalf of the operator of our GOVECS website, Google will use this information for the purpose of evaluating your use of the GOVECS website, compiling reports on GOVECS website activity and providing other services relating to GOVECS website activity and internet usage. Google Analytics is used by us with the User-ID feature. This allows us to create a single coherent entry from the user behaviour of a single user over several sessions and several devices in order to gain a better insight into the surfing behaviour of our users. The use of Google Analytics is based on Art. 6 para. 1 a) DSGVO. You can object to the above described processing by Google Analytics at any time, you will find the corresponding link at the end of this paragraph. We use Google Analytics to analyse the use of our GOVECS website and thus to be able to improve it regularly.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of the GOVECS website. In addition, you can prevent the collection of data generated by the cookie and related to your use of the GOVECS website (including your IP address) and the processing of this data by Google by downloading and installing the browser plugin available at the following link: tools.google.com/dlpage/gaoptout

We will only process your data for as long as it is necessary for the purpose of data collection (here: compilation of statistics and their evaluation). The data sent by us and linked to cookies, user IDs (e.g. user ID) or advertising IDs will therefore be automatically deleted after 14 months. 6.2. Google recaptcha

To confirm the authenticity of your data during the registration for our newsletter GOVECS uses the service reCAPTCHA of the company Google Inc. ("Google"), if you have agreed to the use of this function via the Consent Manager.
Google can be reached at Google Dublin, Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland. The purpose of the query is to differentiate whether the input is made by a human being or abusively by automated, machine processing. The query includes the sending of the IP address and any other data required by Google for the service reCAPTCHA to Google. For this purpose, your input will be transmitted to Google and may be used there. However, in the event that IP anonymisation is activated on this website, your IP address will be shortened by Google within member states of the European Union or in other states which are parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of GOVECS, Google will only use this information to evaluate your use of this service. The IP address transmitted by your browser within the framework of reCAPTCHA will not be combined with other data from Google.
The use of reCAPTCHA is justified in accordance with article 6 paragraph 1 letter a DSGVO.

6.3. Google web fonts

This site uses so-called web fonts, which are provided by Google, for the uniform display of fonts.
If you have previously used these fonts on another site and downloaded them from Google CDN, your browser will fall back to the cached copy. If this is not the case, your browser will download the Web Fonts itself. Google will then know that our website has been accessed via your IP address. A transfer of this data to the USA cannot be excluded.
The use of Google Web Fonts is in the interest of a uniform and attractive presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.
If your browser does not support Web Fonts, a standard font will be used by your computer.

6.4. Myfonts

This site uses web fonts provided by Monotype Imaging Holdings Inc, 600 Unicorn Park Drive, Woburn, Massachusetts 01801 USA ("Myfonts") for the uniform display of fonts.
If you have previously used these fonts on another site and downloaded them from Myfonts, your browser will fall back to the cached copy. If this is not the case, your browser will download the fonts itself. As a result, Myfonts will know that our website was accessed via your IP address. A transfer of this data to the USA cannot be excluded.
Myfonts fonts are used in the interest of a uniform and attractive presentation of our online offers. This represents a legitimate interest in the sense of Art. 6 Para. 1 lit. f DSGVO.

6.5.LinkedIn Insight Tag

If you have enabled the LinkedIn Insight Tag when you visit our website, we will use the LinkedIn Insight Tag conversion tool from LinkedIn Ireland Unlimited Company. A cookie is used to collect the following data with a timestamp, among others: IP address, device and browser characteristics and page events (e.g. page views). The IP address is truncated and within seven days all direct identifiers of LinkedIn members are removed to pseudonymise the data. This data is then deleted after 180 days.
LinkedIn does not share any personal information with us as a website operator, but provides anonymised reports about the website's target audience and display performance. LinkedIn also offers the possibility of retargeting via the Insight Tag. This data allows us, as the website operator, to display targeted advertising outside of our website without identifying you as a website visitor. For more information about LinkedIn's privacy policy, please refer to the LinkedIn privacy policy.
LinkedIn members can control the use of their personal information for promotional purposes in their account settings. To disable ("opt-out") the Insight tag on our website, click on the "Customise privacy settings" button and uncheck "Marketing Analysis".

 

 

6.6.Facebook pixel

If you have activated this via the Consent Manager, we use the so-called Facebook pixel, offered by Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA. This is a small graphic (a single pixel) that is embedded on our website and by means of which information is transmitted to Facebook. The Facebook pixel enables us to recognize visitors to our online offer as a target group for the display of ads within the Facebook platform. This allows us to direct targeted advertising to interested parties within the Facebook platform. Through the Facebook pixel, so-called "conversion tracking" also takes place. This means that it is evaluated whether you have reached our website by means of such an advertisement. This allows us to track the success of our advertising for statistical purposes.
In addition, we use the "extended matching" function within the framework of the Facebook pixel, which uses "Custom Audiences" or "Look Alike Audiences" to transmit the data available to us to Facebook so that a comparison can be made with the data stored with Facebook. This is done so that a broader target group can be identified and addressed for our advertising campaigns.
In principle, Facebook operates for EU citizens via European data centers. However, it cannot be ruled out that, within the scope of this processing by Facebook, a transfer of data to Facebook's headquarters in the USA may take place in isolated cases.
The legal basis for the processing by the Facebook Pixel and the transfer of data to Facebook as part of the extended matching is your consent pursuant to Art. 6 (1) lit. a DSGVO, which you give via the Consent Manager.

 

 

6.7. Google Ads

We have integrated Google Ads on our website. Google Ads is an Internet advertising service that allows advertisers to display ads both in Google's search engine results and in the Google advertising network. Google Ads allows an advertiser to specify certain keywords in advance, by means of which an ad is displayed in Google's search engine results exclusively when the user retrieves a keyword-relevant search result using the search engine. In the Google advertising network, the ads are distributed to topic-relevant Internet pages by means of an automatic algorithm and in compliance with the previously defined keywords. The operating company of these services is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The purpose of Google Ads is to advertise our website by displaying interest-relevant advertising on the websites of third-party companies and in the search engine results of the Google search engine and to display third-party advertising on our website. If a data subject accesses our website via a Google advertisement, a so-called conversion cookie is stored by Google on the data subject's information technology system. A conversion cookie loses its validity after thirty days and is not used to identify the data subject. The conversion cookie is used to track whether certain subpages, for example the shopping cart of an online store system, were called up on our website, provided that the cookie has not yet expired. Through the conversion cookie, both we and Google can track whether a data subject who arrived at our website via such an advertisement generated a turnover, i.e. completed or cancelled a purchase of goods.

The data and information collected through the use of the conversion cookie are used by Google to compile visit statistics for our website. These visit statistics are in turn used by us to determine the total number of users who were referred to us via Google ads, i.e. to determine the success or failure of the respective Google ad and to optimize our ads for the future. Neither our company nor other advertisers of Google Ads receive information from Google by means of which the data subject could be identified.

By means of the conversion cookie, personal information, for example the Internet pages visited by the data subject, is stored. Each time the data subject visits our website, personal data, including the IP address of the internet connection used by the data subject, is transferred to Google. A transfer to the headquarters of Google's sister company, Google LLC in the USA, cannot be ruled out.

By selecting this function in the Consent Manager, you consent to these processing activities. The processing is based on Art. 6 para. 1 lit. a DSGVO.

Users can deactivate Google's services for display advertising and adjust the settings for the Google Display Network via the ad settings.

The data subject can also prevent the setting of cookies by our website at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a conversion cookie on the information technology system of the data subject. In addition, a cookie already set by Google Ads can be deleted at any time via the internet browser or other software programs.

Furthermore, the data subject has the option to object to interest-based advertising by Google altogether. To do this, the data subject must call up the link from any of the internet browsers he or she uses and make the desired settings there.

6.8. hubspot

When contacting us (via form on this website), the user's details are processed for the purpose of handling the respective enquiry and its processing pursuant to Art. 6 (1) (b) DSGVO, if this is necessary for the initiation or fulfilment of a contract with the person concerned. Otherwise, the processing is based on Art. 6 para. 1 lit. f) DSGVO, whereby our legitimate interest lies in the professional and customer-oriented interaction with interested parties and customers.
The user's details are stored in our customer relationship management, registration and marketing automation system "HubSpot". This is operated by the provider HubSpot Inc. (25 First Street, 2nd Floor, Cambridge, MA 02141, USA) with offices in Ireland (One Dockland Central, Dublin 1, Ireland) and Germany (Am Postbahnhof 17, 10243 Berlin). Hubspot is used on the basis of Art. 6 para. 1 lit. f) DSGVO, whereby our legitimate interests lie in the efficient and rapid processing of user enquiries and optimisation of our online offering. For this purpose, we have concluded a contract with HubSpot with so-called standard contractual clauses, in which HubSpot undertakes to process user data only in accordance with our instructions and to comply with the EU data protection level. 6.9. Youtube

If you have activated this via the Consent Manager, we also use embedded content (videos) of the company YouTube LLC, ("YouTube") 901 Cherry Ave., 94066 San Bruno, CA, USA, a company of Google LLC, USA, on our GOVECS website. These are not merely links. If you call up the respective page of the GOVECS website with such content, a connection is established to the YouTube servers and the content is displayed on the website by informing your browser. This transmits to the YouTube server which of our GOVECS websites you have visited. If you are also logged in as a member of YouTube, YouTube assigns this information to your personal user account on the platform. You can prevent such an allocation by logging out of your YouTube user account before visiting our GOVECS website. The use of YouTube is justified in accordance with Art. 6 Para. 1 a) DSGVO. 7. Transfer to third parties

7.1. Hosting Provider

Our servers, and therefore even your data, is hosted at an external service provider, LimTec GmbH, Halderstr. 16, 86150 Augsburg ("LimTec"). LimTec may only access your data as part of our instructions (order processing). LimTec also takes strict technical measures to protect your personal information. LimTec does not disclose your personal information to third parties unless the disclosure is required to complete the agreed services, or LimTec must do so to comply with the law or a valid and mandatory instruction from a government or regulatory body. The data transmitted is limited to the necessary minimum. LimTec stores all information exclusively on servers in Germany.

LimTec is subject to our instructions and is subject to strict contractual restrictions regarding the processing of personal data. Thereafter, processing is only permitted if it is necessary for the performance of the services on our behalf or for compliance with
 
legal requirements. It is decided in advance as to what rights and obligations our service providers should have in relation to personal data.

The legal basis for the processing of your data is article 6, paragraph 1, point f of GDPR. The purpose of data processing is that LimTec offers us the opportunity to use its servers. We only save your data for as long as it is necessary.

7.2. Govecs Group companies and Govecs EU distributors

If necessary, your data may be passed on to companies of the Govecs group as well as to their authorised EU dealers. An overview of the companies of the GOVECS group and the EU dealers can be found here: GOVECS Business Solutions GmbH, GOVECS Inc., GOVECS Poland Sp.z.o.o., GOVECS Sharing GmbH. On the one hand, the transfer of data serves the execution of the contract (e.g. production of the ordered electric scooters and use of the CRM services of Govecs AG). On the other hand, it is possible that the companies of the GOVECS group as well as the authorised EU dealers will also carry out direct marketing to you. All GOVECS companies and EU dealers are obliged by GOVECS to comply with the data protection regulations of the DSGVO and other European data protection standards (order processing).  The legal basis for the use of the data is Art. 6 para. 1 a) DSGVO, provided you have given your separate consent. You can revoke your consent at any time with effect for the future. If forwarding is necessary for the execution of the contract, Art. 6 para. 1 b) DSGVO is the correct legal basis. Furthermore, GOVECS has a legitimate interest in providing the customer with the best possible service. This is done by GOVECS being supported by the other companies of the GOVECS group in the fulfilment of the contract. It is also in our legitimate interest to inform existing customers about new offers and promotions for direct marketing. The legal basis in these cases is Art. 6 para. 1 f) DSGVO.
The data will be deleted insofar as they are no longer necessary for the achievement of the purpose and there are no statutory retention obligations.

8. Your rights

As long as we process your personal data, you are the "data subject" according to the GDPR. As the data subject, you have the following rights to GOVECS:

8.1. Right to information with respect to processing

At any time within the scope of the statutory provisions, you can request information from us as to whether personal data is being processed by us. If this is the case, you have the right to request information about the extent of data processing (see article 15 of GDPR).

8.2. Right to rectification

You have a right to correct and/or complete your data with GOVECS, if your personal data is incorrect or incomplete (see article 16 GDPR).

8.3. Right to restriction of processing

If the conditions are satisfied, you may request the restriction of processing of your personal data (see article 18 GDPR).

8.4 Right to delete

You may request GOVECS to immediately delete your personal information if the conditions are satisfied. The right to delete does not exist if processing is necessary (see article 17 GDPR).

8.5 Right to information

If you have asserted the right to rectify, delete or restrict the processing to GOVECS, GOVECS is obliged to notify all recipients to whom your personal data have been disclosed of this correction or deletion of data or restriction of processing, unless this proves to be impossible or involves a disproportionate effort (see article 19 GDPR).

8.6. Right to data portability

You have the right to receive personally identifiable information you provide to GOVECS in a structured, common and machine-readable format. You also have the right to transfer this data to another company without any hindrance by GOVECS, to whom the Personal data has been provided, if the  conditions  are met (see article 20 GDPR).

 

8.7. Right to object

(see article 21, paragraph 1 GDPR).
The consequence of objection is that GOVECS no longer processes the personal data related to you, unless GOVECS can prove compelling legitimate reasons for processing that outweigh your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending of legal claims.

If the personal data related to you is processed in order to operate direct mail, you have the right to object at any time to the processing of your personal data for the purpose of such advertising (see article 21, paragraph 2 of GDPR).
Please appeal to us with your objection (paragraph 1 of this declaration). You have the right, at any time, to object to the processing of personal data concerning you, pursuant to article
6, paragraph 1, sentence 1, point f of GDPR  for reasons arising from your particular situation.

 

8.8. Right to revoke the data protection consent declaration

If you have submitted a data protection consent form, you can revoke it at any time (see article 7 of GDPR). The revocation of consent does not affect the legality of processing carried out on the basis of the consent until revocation.

8.9. Right to complain to a supervisory authority

Without prejudice to any other administrative or judicial remedy, you shall have the right to complain to a supervisory authority, in particular in the Member State of its residence, place of work or place of alleged infringement, if you believe that the processing of your personal data is against the GDPR (see article 77 GDPR).

9. Safety standards

GOVECS has implemented appropriate physical, technical and administrative security standards to protect personal information from loss, misuse, alteration or destruction. Our service providers and affiliates have a contractual obligation to protect the confidentiality of personal information. In addition, they may not use the data purposes that are not authorized by us.

We may update this privacy policy from time to time. We therefore recommend that you read this privacy policy regularly to understand our privacy practices. This privacy policy was last updated on 02.10.2020.
